Note:
A New York appellate court affirmed dismissal of an action by a New York importer for lack of jurisdiction. The court rejected the plaintiff's argument that jurisdiction was conferred by a reference in a LC to a forum selection clause "which refers only to the bank's understanding of a term of the separate, independent, and undocumented commercial agreement. ..."
