Jurisdiction: Long Arm Statutes.

Note: The U.S. District Court for the Southern District of Indiana, Barker, J., denied a Motion to Dismiss for Lack of Personal Jurisdiction in a claim brought by a pension fund located in Indiana against defendants in connection with a real estate investment for violation of securities laws, racketeering activities, and fraud. In concluding that the defendants, who were not residents of Indiana, subjected themselves to the Indiana long arm statute, the court noted that they had deposited a LC with an Indiana escrow agent. "In depositing their letter of credit, the individual defendants were clearly availing themselves of the benefits and protection of Indiana law and consequently were conducting business in the forum."
