We wish to thank the readers who provided positive feedback about the first edition of this book, which encouraged us to issue a second edition that incorporates some of the latest judgments from the Federal Court, the Court of Cassation in Abu Dhabi, Dubai Court of Cassation and the DIFC Courts.
This book originated out of the initiatives of the Steering Committee of the ICC UAE Commission on Arbitration, which was established with the objective of promoting dispute resolution mechanisms in the UAE through various programmes including educational events, studies and networking.
In line with the first edition of this book, the second edition contains summaries of the selected judgments to provide the reader an insight into (i) the facts of the case; (ii) the principle(s) relied upon by the court to render its decision; and (iii) the reasoning of the court leading to its decision. These summaries are aimed at helping arbitration practitioners in the UAE to identify the principles set out by the UAE courts with respect to arbitration.
The editors are greatly indebted to several individuals without whose input this book would likely not have progressed. The editors offer continued thanks to all the members of the “ICC UAE Book on UAE Courts’ arbitration case law” taskforce who contributed to the first edition of this book and who continue to offer their time and support to the ICC.
