The parties to this agreement agree to have recourse, if the need arises, to the International Centre for Expertise of the International Chamber of Commerce in accordance with the ICC's Rules for Expertise.

Note:

Since expertise and arbitral proceedings are distinct, the ICC recommends parties to separate technical and legal disputes in contracts by inserting the model clause for expertise, in addition to the arbitration clause.

This does not prevent the possible use by ICC arbitrators of the services of the International Centre for Expertise if they need to appoint technically qualified experts.
