This paper, which was initially prepared for the 12th ICC New York Conference last September, was inspired by parties’ demands for dynamic dispute resolution options. It presents some of the possibilities that expert determinations offer. Expert determinations can be integrated into larger dispute resolution frameworks and are compatible with international arbitration. Expert determinations are particularly effective for resolving specific – and often reoccurring – fact issues that trigger specific contractual outcomes.
