ICC Arbitration under the Orgalime Conditions

Orgalime is the European federation that represents the interests of European mechanical, electrical and metal industries. Like FIDIC in the construction industry, Orgalime provides a series of model conditions aiming at achieving some standardisation in the field of contracts for delivery of machinery and similar industrial products. The Orgalime Conditions are therefore relevant for all companies that operate in the engineering sector. They are used worldwide and provide for the resolution of contractual disputes under the ICC Rules of Arbitration. The authors have been given exclusive access to a selection of ICC awards settling disputes under the Orgalime Conditions. Whilst this article does not deal with all issues that may arise under the Orgalime Conditions, it will examine some of their most salient features as discussed in these awards.
