Applying FIDIC Dispute Resolution Concepts and Dispute Boards in the CEE Region

This article discusses the contemporaneous issues in the CEE countries when dealing with construction disputes and the local adaptations made to the FIDIC general conditions or dispute board process. The author identifies four subjects that reflect the specificities in a region where major infrastructure construction projects are in place (forfeiture of claims, the mandatory or optional nature of dispute boards, whether the dispute decision is binding, and the role statutory bodies might play in resolving construction disputes), with a reference to the latest developments in the Czech Republic, Hungary, Poland, and Romania.
