Final Award in Case 8818 (Extract)

The claimant, a bank in an East European country, obtained loans from three French banks (respondents) to finance an industrial project to be realized by a French company (A) for an East European company (C). The claimant sought to have the loan agreements declared null and void due to misrepresentation on the part of the first respondent when they were being negotiated. In addition, the claimant accused the respondents of fraud and breach of contract in the performance of the loan agreements.

La demanderesse, une banque d'un pays d'Europe de l'Est, obtint auprès de trois banques françaises (les défenderesses) des prêts pour financer un projet industriel que devait réaliser une société française pour le compte d'une société d'Europe de l'Est (C). La demanderesse agit en annulation des conventions de crédit en raison du dol qu'aurait commis la première défenderesse lors de la conclusion de celles-ci. La demanderesse reproche également aux défenderesses des fraudes et des manquements contractuels lors de l'exécution desdites conventions.
