Final Award in Case 9941 (Extract)

The claimant, a bank in a North African country, granted a loan to a company (A) in the same country. The loan was in part guaranteed by the respondent, a French bank. Following A's failure to reimburse any instalments of the loan, the claimant called the guarantee. The respondent refused to pay, arguing that it had not given a first demand guarantee but was entitled to the same rights as the lender. The sole arbitrator first considered the law applicable to the guarantee and the nature of the guarantee.

La demanderesse, une banque d'un pays d'Afrique du Nord, octroya un crédit à une société (A) du même pays. Le prêt était en partie garanti par la défenderesse, une banque française. La demanderesse appela la garantie, la société A n'ayant remboursé aucune échéance du prêt. La défenderesse refusa de payer au motif qu'elle n'avait pas fourni une garantie à première demande mais, au contraire, disposait des mêmes droits que le prêteur. L'arbitre unique examine d'abord le droit applicable à la garantie et la nature de celle-ci.
