The parties, two construction companies based in Europe (the claimant in State A and the respondent in State B), entered into a joint venture agreement for the purpose of preparing a tender for a construction project in the Middle East. The parties were awarded the construction project and subsequently entered into various maintenance contracts relating to the resulting building. A court case was brought against the parties in connection with the construction and maintenance of the building. The claimant initiated arbitration proceedings, arguing that the respondent had violated its obligation to cooperate with it.
