In order to build a sport's stadium, a Caribbean State engaged the services of the Respondent/Employer, a Caribbean company, which, in turn, entered into a construction contract with the Claimant/Contractor, also a Caribbean company, which the Respondent/Employer terminated on account of the Claimant/Contractor's alleged default. The Claimant/Contractor initiated arbitration proceedings, claiming the termination of the contract was wrongful, and sought damages for, among other things, sums allegedly due and owing under the contract and the value of alleged variations.

Afin de construire un stade, un Etat des Caraïbes a engagé les services du défendeur/maître d'ouvrage, une entreprise des Caraïbes qui, a son tour, a conclu un contrat de construction avec le demandeur/entrepreneur, lui aussi une entreprise des Caraïbes, que le défendeur/maître d'ouvrage a résilié au motif que le demandeur/entrepreneur aurait manqué à ses obligations. Le demandeur/entrepreneur a entamé la procédure d'arbitrage affirmant que la résiliation du contrat était abusive et cherchant à obtenir des dommages-intérêts, entre autres, pour des sommes qu'il prétendait être dues et impayées aux termes du contrat et pour la valeur des modifications alléguées.
