In 1996, the parties, both traders in hydrocarbons, entered into a contract for the supply of petroleum products needed by Claimant to perform a procurement contract with the government of an African State. The reference to the Incoterms rules in the parties' contract was used by the arbitral tribunal to determine the applicable rules of law.

En 1996, les parties, toutes deux vendeurs d'hydrocarbures, conclurent un contrat prévoyant la fourniture de produits pétroliers dont le demandeur avait besoin afin d'exécuter un contrat d'approvisionnement conclu avec un Etat africain.
