In 2004, a French company (Claimant) entered into a contract for the sale of an organic compound to a Moroccan company (Respondent). The contract was governed by the 1980 United Nations Convention on Contracts for the International Sale of Goods and subject to the application of the 2000 Incoterms rules and, for any parts not covered by the CISG or the Incoterms rules, French law.

En 2004, une société française (le demandeur) souscrivit un contrat de vente d'un composé organique à une société marocaine (le défendeur). Le contrat était régi par la Convention des Nations Unies de 1980 sur les contrats de vente internationale de marchandises et soumis à l'application des règles des Incoterms 2000 et, pour toute partie non couverte par la CVIM ou les règles des Incoterms, par le droit français.
