Final Award in Case 6941 (Extract)

In 1989, an Algerian company (Respondent) undertook to sell a food preservative to a Norwegian company (Claimant). Their contract was governed by French law and subject to the application of the 1980 United Nations Convention on Contracts for the International Sale of Goods. When the goods arrived at their destination, they were found to be soiled and unfit for their intended purpose. Claimant sought the reimbursement of the sums it had already paid, while Respondent offered a price reduction. As an amicable solution could not be reached, arbitration proceedings were initiated.

En 1989, une société algérienne (le défendeur) souscrivit un contrat de vente d'un produit de conservation alimentaire à une société norvégienne (le demandeur). La Convention des Nations Unies de 1980 sur les contrats de vente internationale de marchandises s'appliquait à ce contrat qui était régi par le droit français. Il fut constaté, lorsque la marchandise arriva à destination, qu'elle était sale et inadaptée à l'usage auquel elle était destinée. L'acheteur chercha à obtenir le remboursement des sommes qu'il avait déjà versées, tandis que le vendeur lui proposa une réduction de prix. Une procédure d'arbitrage fut engagée à défaut d'accord amiable.
