Final Award in Case 8046 (Extract)

In 1991, an Algerian company (Claimant) contracted to sell to a French company (Respondent) a given quantity of cereals to be delivered to a French port. Upon delivery, the goods were found to contain a higher than normal proportion of one of their constituents. The buyer agreed to pay part of the price and proposed an amicable settlement for the rest. The seller refused and initiated arbitration proceedings, in which the Incoterms rules as defined by ICC were applied to the merits of the dispute.

En 1991, une société algérienne (le demandeur) consentit à vendre à une société française (le défendeur) une quantité donnée de céréales devant être livrée dans un port français. Il avait été constaté, à la livraison, que la marchandise comprenait une proportion anormalement élevée de l'un de ses constituants. L'acheteur accepta de payer une partie du prix et proposa, pour le reste, un règlement amiable. Le vendeur refusa et engagea une procédure d'arbitrage, dans laquelle furent appliquées au fond les règles des Incoterms telles qu'elles avaient été définies par la CCI.
