In 1992, pursuant to a framework contract, Claimant, a Bulgarian company, delivered goods to Respondent, an Austrian company. A dispute arose between the parties over the date of delivery, which was delayed due to war in the region through which the goods were to travel. Claimant initiated arbitration proceedings to recover the price of the goods supplied, while Respondent claimed damages for delayed performance, alleging that Claimant bore full responsibility for transport in accordance with the Incoterms rule DDU mentioned on its invoice. The framework contract mentioned French law as the applicable law.

En 1992, conformément à un contrat cadre, la demanderesse, une société bulgare, a livré des biens à la défenderesse, une société autrichienne.
