In 1996, a Dutch company (Claimant) agreed to sell equipment to a French company (Respondent). Claimant initiated arbitration proceedings to recover the outstanding part of the purchase price, which Respondent refused to pay, alleging that it was exempt from paying due to the fact that the equipment failed to function correctly and for this reason had not been duly accepted. The sole arbitrator rendered an interim award on applicable law in which reference was made to the 1990 Incoterms rule CPT.

En 1996, une société néerlandaise (demanderesse) s'est engagée à vendre du matériel à une société française (défenderesse). La demanderesse a engagé une procédure d'arbitrage afin de recouvrer la partie non réglée du prix d'achat, que la défenderesse avait refusé de payer, au motif qu'elle était exonérée de son obligation de paiement du fait que le matériel ne fonctionnait pas correctement et, pour cette raison, n'avait pas été accepté. L'arbitre unique a rendu une sentence intérimaire sur le droit applicable, dans laquelle il est fait référence à la règle CPT des Incoterms 1990.
