sending dox and requesting payment by fax
Hi, It is not easy to give a correct answer without seeing the L/C. 1. My understanding is that the L/C is available with the nominated bank by deferred payment and the nominated bank which agrees to act on its nomination is requested to send the issuing bank a swift message certifying that it has t...

various origins and partial shipments
Hi, Goods may have multiple origins. Where a certificate of origin is issued for a consignment containing a number of products of different origins, it indicates the country of origin against each product listed. Sworn clause
Hi,
The issuing bank cannot raise the discrepancy, e.g., “the certificate not countersigned by notary public” based on the wording “sworn before me”. If the issuing bank intends that the certificate is to be countersigned by notary public, it must so state in the L/C.
Kind regards,
N.H. Duc

What is the meaning of demand
Hi, The issuing bank needs time to determine the compliance of the demand as well as to process the payment. Where the guarantee is not subject to ICC rules but local law, the timing depends on the local law. Taking Vietnam’s law on bank guarantees as an example, the guarantor is obliged to pay not ...
