B/L signature

It isn't a discrepancy. Hanoi office is the location and not the name of the agent signing on behalf of the carrier.

Beneficiary's draft

Since your l/c is available with you (issuing bank) by payment, the request for presentation of a draft is pointless. So, delete it.

'bill of exchange' versus 'exchange'

See if this link helps. Anyhow, I do agree with Antoine. If words "pay against this sole of exchange" or "pay aginst this single of exchange" or similar wording are incorporated within the text, is enough to determine the type of document. http://www.ddegjust.ac.in/studymaterial/...

date of issue of a FCR

FCR must only certify that the freight forwarder is in possesion of the goods. A further information, if required under the credit, can be related to the entity at whch disposal the goods arre kept. There is no need for a date of issuance or a date related to the taking over the goods by the freight ...

invoice containing 'free of charge' goods

Since cannot be established if the furniture free of charges is of same type/quality/size,etc. with the furniture called for in the credit, par.64 of ISBP681 applies and documents are discrepant. In my opinion, if l/c would have state "chairs model ABC brown" and the goods free of charges ...

Is 'fixture notes' equal to 'charter party'?

It is important to know if the b/l presented evidence the freight being payable as per charter party dated...(date indicated) or just indicate the freight (prepaid or collect) as required by the credit. If no reference is made to a dated charter party, I think the b/l can be accepted as issued as pe...

para 100: B/L must indicate actual port of loading and disch

B//l must evidence the named ports of loading and discharge which must be within the geographical area stated in the credit.
Consequently, the b/l is discrepant.

instalment

A single period stipulated for partial shipments cannot be considered an instalment and consequently art.32 is not applicable.
Unless you find any other discrepancy, docs evidencing further shipments between given period will comply with credit terms.

isuer's signature on B/L

Agree with Daniel.
B/l must evidence on whom behalf the agent is signing : (for or on behalf of carrier) or (for or on behalf of the master).
Consequently, the b/l is discrepant in its actual form.

NDC

UCP600's subart.14d and 4a apply.
As long as the document make reference to the proforma indicated in the credit and comply to all other terms of the credit and can be correlated with any/all other docs presented, the packing list is ok.
My best wishes,
Bogdan
