L/C is transferable
The clause as stated does not modify article 38. By this clause it means the LC is a transferable LC. If the LC is available with a named nominated bank, the nominated bank may transfer the LC at the request of the beneficiary. If the LC is available with any bank, it has to specify a bank to be the...

Whether it is late presentation
Andy, Sub-article 29a pertains to a situation where the expiry date or latest presentation date falls on a non-banking day (e.g., a public holiday in the place for presentation), in which case the expiry date or latest presentation date, as the case may be, is extended to the first following banking...

Whether it is late presentation
Hi, N.H.Duc. Thanks for your comments. If the nominated bank certified that the beneficiary's documents were presented within the 21-day presentation period but then there was delay in dispatch of the documents by the nominated bank to the issuing bank probably due to oversight, would the issuing ba...

Whether it is late presentation
LC that is available with any bank in the beneficiary's country calls for original bills of lading and does not stipulate a period for presentation. Documents were received by the issuing bank within the validity but almost two months after the shipment date. It appears that either (a) the documents...

Sladjana,
You may refer to the first paragraph of article 35 for an answer to your query. Applying article 35 in this case, the issuing bank assumes no liability or responsibility for the consequences arising out of the loss of documents in transit.

Agreed with Andy. The beneficiary should have sought an amendment to the LC in regard to the insurance document requirement.

Express bills of lading
There does not seem to be an authoritative definition as to what an express bill of lading is. I tried to google it but could not find a consistent definition. As such the LC that incorporates this term should define it within the LC, otherwise the term will be disregarded. The BL presented evidenci...
