Is Lmited Limited?

I would appreciate your comments on the behaviour of an issuing bank that refused a set of documents for - in our view - a spurious discrepancy disguised as strict compliance. ABCD Banking Corporation Limited issued a letter of credit, available at its counters, that required the presentation of a b...

Discrepancy: 0 or O

Thank you so much for your valuable comments. The problem was satisfactorily solved as the issuer recognised the lack of grounds for its position. Acceptance by a bank or an applicant?

If the applicant waives the discrepancies noted and the waiver is accepted by the issuing bank, he is supposed to take up the documents from the issuing bank. Delivery of documents to the applicant makes the issuer liable to honour, even if its message is not, in some occasions, as clear as it shoul...

Non-original Insurance policy

Even if the document has been elevtronically generated in its entirety (signature included) banks are to treat it as an original.

Various CMR;Late presentation?

First, thank you for your participation. We had the oportunity of approaching this question with Mr. Xavier Fornt from ICC Spain who thinks that art 31 b) simply does not apply in this particular case because there are different means of conveyance (six different trucks) and therefore, even if the p...
