signing bill of lading as agent

we would appreciate your opinions on the following claimed discrepancy : we have a bill of lading on the letter of head of the carrier. At the signature line we have the following: "carrier name" as carrier by (signature ) "agent company" as agent. The issuing bank noted that the...

ISBP rev. 2007 - Paragraph 64

I would tend to agree with Kim. I was thinking as well that the purpose of this paragraph is just to underline that no OTHER goods are to be shipped and shown in the invoice. But as long as it is the same as what is actually required in field 45A of the credit, I see no reason to claim the indicatio...

ISBP rev. 2007 - Paragraph 64

Hello, I would like to have some opinions on how to read the paragraph 64 of the ISBP rev.2007 in regard to the following case: We had a presentation of documents under a credit which was showing as description of goods ''cosmetics'' (no quantity stipulated). The invoice presented was indicating 10 ...

trust receipts for release of goods and discrepant documents

Thanks for your reply Jeremy. Now another question with regards to the amount: If the invoiced amount exceeded the credit value, would you pay the credit value or the invoiced value? (Assuming the issuing bank could not recover the invoice value from the applicant.)

trust receipts for release of goods and discrepant documents

I’m curious how banks approach the matter of release of goods against a trust receipt. Do they subsequently insist the applicant sign the release is against his automatic acceptance of “any/all” discrepancy/ies? If so, when the relative documents are received, does the bank check them? If so, does t...

appearance of insurance certificate/declaration

Kim/Jeremy Thanks for your views. My concern is really that the document does not indicate who can claim on it. Ended up calling the insurance company who advised that they normally mention the beneficiary of the certificate (either the dc benef or app) but because the dc benef had not advised them ...

appearance of insurance certificate/declaration

Kim, Thanks for your reply, it was much appreciated. I wonder if this certificate/declaration does not need to show an insured party? The incoterm in this case is CIP which means that the risk passes once the goods are delivered to the carrier. Hence it should follow that the insurance should then s...

appearance of insurance certificate/declaration

The documentary credit states “insurance policy/certificate for 110 pct of the invoice value covering all risks”. We received a document physically typed on the insurance company’s letterhead. The text is not the customary lengthy text appearing either in printed matter or printed text from what app...

do copies need to be signed

let's say for all intensive purposes, that it did state invoices in plural, how would be copies need to be signed? Photocopy of signature from original document? Originally signed copies? Either or?

do copies need to be signed

thank you Bill for your comments. I am of the same opinion but thought I'd throw the question out there as I just had an issuing bank refuse documents on those grounds.
