I would regard such a document as complying.
Incidentally the case of KREDIETBANK ANTWERP V MIDLAND BANK (1999) concerned a documentary credit issued Midland Bank requiring presentation of a ‘Survey Report’ and a ‘Certificate of Quality’ issued by ‘Griffith Inspectorate’. The documents presented:
> were headed and signed by ‘Daniel C. Griffith (Holland) BV’ and
> had, at the foot of the documents, a logo which contained the sole word ‘Inspectorate’ and underneath the words ‘MEMBER OF THE WORLDWIDE INSPECTORATE GROUP’.’
Midland rejected the documents as they were ‘not issued by ‘Griffith Inspectorate’’. However, both the Commercial Court and the Court of Appeal held the documents did comply with the credit terms.
