Hi,

The signature box of a bill of lading titled “ ABC LANE SHIPPING LTD AS THE CARRIER BILL OF LADING” shows as follows:

STAMP & SIGNATURE OF THE CARRIER OR ITS AGENT (pre-printed)

For and on behalf of
ABC LANE LOGISTICS CO., LTD

(signed)

Authorized Signature (s)
-------------------------------------------------------

It seems to me that ABC LANE LOGISTICS CO., LTD signed the bill of lading in the capacity of an agent of the carrier - ABC LANE SHIPPING LTD. However, what is shown in the signature box fails to comply with UCP 600 sub-article 20 (a) (i).

I believe that it is close enough and would accept it as the carrier's "agent" though I understand that this will probably not be a popular stance. In this instance it would be hard to go to a court and say it is not exactly as envision with UCP.

It seems to me that the statement ‘STAMP & SIGNATURE OF THE CARRIER OR ITS AGENT’ can only be taken as meaning that if ABC LANE SHIPPING LTD does not sign the BL then any party that does must automatically be the carrier’s agent. Therefore, I take the view that it is indicated that ABC LANE LOGISTICS CO., LTD has signed for or on behalf of the carrier in accordance with sub-Art. 20(a).
