Instalment shipments

Post by THI THUY MYT_ » Thu Dec 01, 2011 12:00 am

Dear all,
I would like to have yr opinions on the following case:

L/C states :
Field 44D shipment period:
+ For item 1: latest shipment date 111022
+ For item 2: latest shipment date 111026

With the above mentioned requirement, can we check the docs base on article 32 Installment shipment ?

In case the 1st shipment 's short shipment or late shipment, will the L/C cease to be available for that shipment and the next shipment?

Tks

Hi,

Your case is to some extent similar to the case described in R313 (Query 2, Example 1). It is understood from your description that Item 1 and Item 2 may be shipped in full as one shipment by 22 Oct, 2011 or at least Item 1 must be shipped in full by 22 Oct, 2011 at the latest.

Article 32 would apply to this case. If the first shipment is short or not made within the given period, then the L/C would cease to be available for further drawings.

Dear Mr Duc,
"If the first shipment is short or not made within the given period, then the L/C would cease to be available for further drawings."
So, is it similar if the 1st shipment's over shipment?
Thanks for yr help

Instalment shipments

H.N.Duc,
There are latest dates of shipment but I wonder if there are instalements. After all, item 2 could be shipped within the time period allowed for item 1.

@Unhu: Yes.
@ Daniel: I also wondered if there are instalment shipments. However, this case is much the same as the case described in R313 (Query 2, Example 1) which says that if the first shipment is not shipped within a given period the L/C would cease to be available for further shipments. So Article 32 could apply to this case.

I agree with you that item 2 could be shipped within the time period allowed for item 1.
