SBLC - Copy of original BL required

SBLC subject to UCP600 requires presentation of "PHOTOCOPY OF THE FRONT AND BACK OF ORIGINAL CLEAN ON BOARD BILLS OF LADING ISSUED OR ENDORSED TO THE ORDER OF [issuing bank], FAX COPY ACCEPTABLE".

Copy of front and back of Charter Party BL is presented, meeting all the criteria of the above SBLC requirement.

ISBP clause 20 tells us that if the LC requires presentation of a copy of a transport document, that it should not checked according to articles 19-27 and that the content of the transport document must be stipluated.

Who agrees that the CP BL is acceptable and who thinks it is not acceptable?

David,

I see you are covering 'all the bases' with this one. As I said elsewhere, I have no doubt that a CPBL does not transgress the terms of the standby. What I find funny about Albert is that his reasoning is correct but the answer he gives goes completely against it.

No doubt you would appreciate the views of others here.

Question is whether the term "Bill of Lading" includes all varieties - ocean, multimodal, charter, forwarders, short form, blank back, ...
If answer is yes, then it's OK with a CPBL.
If answer is no, then a CPBL is not acceptable.
What ISBP para 20 says is that a copy of transport documents need not be examined in accordance with the article governing the requested document, i.e. one between 19 and 27.
Which document is requested depend, as said, on how you interpret the term "Bill of Lading".
I am a bit divided ...

Par. 20 deals with the detail to be shown in a copy of a transport document not with the type of the transport document. If we accept the copy of the C/P B/L we should also accept the presentation of a copy of an air waybill. In my oppinion when a copy of a B/L is required it must at least be the copy of a B/L and not a C/P B/L, AWB and so on.

SS & DD - The very first sentence in ISBP 20 states "Copies of transport documents are not transport documents for the purpose of UCP 600 articles 19-25 and sub-article 14(c)."

However, the question is still: is photocopy of original CPB/L acceptable when SBLC calls for a photocopy of original B/L.

Answer depends on interpretation of a term "Bill of Lading". If it interprets as a term that includes all varieties of Bill of Lading, i.e ocean B/L, multimodal B/L, charter party B/L, forwarders B/L, short form B/L, blank back B/L, ... than it's OK with a photocopy of CPB/L, because it is also B/L, otherwise not.
