L/C requirement:
+ ALL REQUIRED DOCUMENTS MUST BE DATED, BUT NOT DATED PRIOR TO THE ISSUANCE DATE OF THIS CREDIT.

Is the B/L showing the same date of issue as the L/C, but with an on-board listing that is two days prior to the issue date of the L/C acceptable, i.e.:

Date of L/C issue: 2011-12-22
Date of B/L issue: 2011-12-22
On board date: 2011-12-20

It is possible that issuing bank’s intention was to prohibit shipment prior to the L/C issuance, but that's not what it states in the L/C.

However, it seems to be acceptable as the B/L is dated and it is not dated prior to the L/C issuance date (while shipment is effected before issuance date of the L/C, but the L/C does not prohibit it).

Hi,

The B/L meets the L/C requirement. If the issuing bank’s intention is to prohibit shipment prior to L/C issuance, this should be so stated in the L/C.

In case of use I also do not regard the BL as being non-compliant.

This question seems to be quite interesting. There are different opinions, among those I've talked to, if B/L is acceptable or not.
As I said, I should accept.

See Fortis Bank and Indian Overseas Bank where a B/L date is a B/L date and a shipment date
is a shipment date. Exception: ISBP 43 C and 47

I also agree. Not a discrepancy. A date of shipment may and typically does differ from a BL date (BL date is the date they are signed).
