IRRESPECTIVE OF PERCENTAGE

Post by EMILYTRAN » Tue Mar 29, 2011 1:00 am

Please kindly give us your opinions for the following case:
As per Para 177 of ISBP, if L/C required insurance cover to be irrespective of percentage, the insurance would be discrepant if contain a clause stating that the insurance subject to a franchise or an excess deductible. In case L/C did not require insurance cover to be irrespective of percentage but insurance document stating that the insurance subject to a franchise or an excess deductible. Is it make the doc conflict itself?

IRRESPECTIVE OF PERCENTAGE

Surely sub-Art 28(j) applies here? Or are you saying that the insurance document actually states cover is irrespective of percentage AND that the cover is subject to a franchise or an excess deductible?

If the L/C does not require insurnce to be irrespective of percentage, then art 28j applies, i.e. an insurance document may indicate that the cover is subject to a franchise or excess (deductible).
