Character of n.n. copies of a bill of lading

Post by GerhardH » Tue Dec 19, 2006 12:00 am

Hi all,
i need your help determining the character of non-negotibale copies of a B/L under a L/C.
If a credit requires the following document:
clean negotiable fiata multimodal transport B/L in one original and 4 n.n. copies...
Is this condition fulfilled when presenting photocopies of the front side of original B/L or do i have to present copies of the B/L that includes freight conditions on the reverse side.
Thank you very much for your help.
Best regards

Gerhard,

There are n.n. copies of B/L "as such". I would be more comfortable
with such an "original" n.n. copy than with a photocopy of the original B/L even if a photocopy is a copy. I am afraid we are not yet finished with originals and copies.

Dear Gerhard,

My view would be that ”n.n. copies” would merely indicate that these copies must not be “negotiable” – i.e. it should not be possible to transfer ownership of the goods based on those.
In that respect if what is presented is clearly a “copy” (i.e. not the original) – I would not have a problem with that – as that would in effect be “non negotiable”.

Best regards
Kim

Ps. I would also be more “comfortable” with the real “non negotiable copies” – but would not think that copies of the original would constitute a valid discrepancy here.
