Dear all I would like to get your opinion regarding the below mentioned issue:
Art. 13-a of UCP 500 states that documents not stipulated in the credit will not be examined by banks and if banks receive such documents they shall return them to the presenter or pass them without responsibility. Whereas art. 14-g of UCP 600 states that a document not required by the credit will be disregarded and may be returned to the presenter. There is no indication about sending the documents without any responsibility to the issuing bank.
Do the banks still have the right to send the documents without any responsibility?
Under a confirmed export L/C subject to UCP 600 if we receive a document which is not required by the credit and send it to the issuing bank without any responsibility, does issuing bank have the right to examine this document and raise discrepancy as per a/m art. of UCP 600.?
Accordingly under an import L/C what should we do as an issuing bank if we receive such documents?
