Art 20 & ISBP para 13

Post by RaymondC » Wed Oct 17, 2007 1:00 am

According to Article 20 aii, the date of shipment in the on board notation will be deemed to be the date of shipment if the B/L had both the issue date and a dated on board notation.

Per paragraph 13 of ISBP, transport document must be dated even not mention in the LC.

If we have a B/L with the issue date missing but contains a prepinted on board notation with a shipment date, could we accept this B/L or quote the discrepancy "B/L not bearing an issuing date"?

Thanks

Raymond,

My personal opinion is that there is not any requirement for a BL to have an issue date separate from any on board statement (whether pre-printed or in the form of a 'notation').

I would regard the OBN as being the date of the BL.

Dear Raymond,

You can argue both ways. I think that this issue will be addressed next week at the BC meeting in Paris – so perhaps better to way for the answer till after that one :-)

Thank you both Jeremy and Kim.

It would be quite an interesting coincident that similar topic would be discussed in Paris in the coming week.
