NBK London appealed and the English Court of Appeal upheld (on 3 Jul 81) the High Court’s (court of first instance) judgment in favour of Power Curber. Leave to appeal to the House of Lords (the U.K.’s ‘supreme court’) was refused. (Incidentally, the English courts considered the credit to be subject to North Carolina law, but it did not stop them giving judgment.) Suggest you contact your bank’s legal dep’t to contact your bank’s U.K. lawyers see if they can get a copy of the judgment if you want full details.
