Jeremy,

I think that most people would logically consider an Article titled "Marine/Ocean" B/L to be written about transport by sea, as opposed to other possibilities. Where this does not require any psychic abilities, if the Article omitted the words "Marine/Ocean", then one certainly would be in need of these powers to conclude what the remainder of the Article was about.

If banks always issued DCs as they should and beneficiaries always presented documents in full consideration of the DC & UCP, we would have no Discussion Forum and many of us would be seeking new careers. As I see it, there are two main reasons why this does not happen -
1. Human error
2. Lack of knowledge, training, expertise on the part of some or all parties involved (incl. applicants).

The first of these will always be present, but may be reduced by computerised systems. The second subject (training etc) has already been thrashed to death in discussion, so I will not pursue it here.

We share your opinion that there is a need of intensive training for bankers on UCP 500. That is the reason why Gary Collyer received so many educational queries from banks that he could not manage by himself and for a certain period in the past these queries had to be handled by a team of ICC Experts, like Reinhard Langerich of Nordea Bank, Ole Malmqvist of Den Danske Bank and perhaps Heinz Hertl of Bank Austria. As the Experts are changing, we quote according what we know and the names given here, like examples provided by ICC, are not exclusive of course.

Now these educational querries would be firstly answered by the National Committees themselves, copied to and to be checked by the ICC Banking Commission.

That is also the reason why consultants could not retire early, as they do not have enough business from training. Fortunately as a by-product of lack of training, we have more consultancy work to keep us alive. Agreed?

it may be anomalous to say so, but if we are 100% successful in our delivery of training, we promote our own commercial failure, as there would be no need for consultancy or further training.

However, I will not lose too much sleep over the possibility of that !

I disagree that when bankers were all full trained, consultants would have NO business. Whenever you have human beings, who are still putting self-interest on top of everything, we still have disputes. Only that at that time, the disputes would be more technical and sophisticated as all bankers are more learned.

For the same reason, we do not believe that we can eliminate trade disputes all together in e-commerce. Instead of paper disputes, we would have e-disputes, to be determined by the e-courts with e-laws and e-ISBP by the e-Judges, who still need the e-DC experts. But by that time we should have retired. Otherwise we cannot claim that we are successful consultants.
