Article 20a

According to Article 20a of UCP600, ‘Any signature by an agent must indicate whether the agent has signed for or on behalf of the carrier or for or on behalf of the master’. 

If we receive a B/L which shows ABC as agent and XYZ as Carrier, can we consider this is a discrepancy though Article 94a of ISBP (2007) states, ‘If an agent signs a bill of lading on behalf of the carrier, the agent must be identified as agent and must identify on whose behalf it is signing, unless the carrier has been identified elsewhere on the bill of lading’.

Please advise.

Did the signing agent indicate who they were agent for? If they signed as agent for the carrier, and the BL identifies the carrier, the BL complies with the sub article. If the signing agent failed to indicate who they are agent for, then the BL does not comply.

BL only shows as agent and as carrier.
