In Case of an L/C, it was a condition that the certificate of analysis & G.C. report should be issued by the manufacturer.
Now the problem is that the certificate of analysis only carries a name and under which in bracket manufacturer is endorsed. In effect certificate of analysis does not show the address of the manufacturer or any indication by way of any notation, stamp etc. to show that on whose behalf that document is issued.Under these circumstances is this document acceptable under UPDC 500.
The G.C. report does not carry any indication to show that manufacturer has issued the same. However below the G.C. report wordings the stamp of shipper appears. Further the G.C. report is in Chinese language whereas all other documents are in English.Secondly the G.C. report does not carry any cross reference to any other shipment document or product shipped. Can this document be accepted under UPDC 500. Would be grateful to receive comments by email on rajivgupta2001@yahoo.com

Without seeing the L/C & related documents, it is difficult to give a definitive statement on this subject. However, based on this message, let us consider the following :

Cert. of Analysis
It is unclear whether the beneficiary, manufacturer and shipper are one & the same. If they are, it may be possible by comparing signatures to validate the document issued as Cert. of Analysis. Otherwise it would appear that not enough information is available in the document to allow it to be accepted as the Cert. of Analysis.

G. C. Report
Again it is unclear whether the shipper and manufacturer are one and the same. If they are, then the stamp of the shipper would appear to suffice. In the absence of conditions in the L/C calling for specific content, or limiting content to the English language, Article 21 applies.
Unless the L/C calls for this or all documents to be cross-referenced, there is no requirement for this.

The certificate must have some linkage with the shipment. That is an implied condition of the UCP 500 and according to the judicial decisions of many LC court cases.

As the enquirer has not shown the whole certificate, it is difficult to give a firm answer based on the enquirer's short description.

I would suggest that DC PRO is able to include an electronic image along with the text of future enquiries.

Hi, examining 20-25 documents a day if I come up with something like this I would accept the document. Reason: if L/C is silent about who is to be the issuer than it could be anyone, be it by name (abc or xyz co) or bene, manufacturer etc....
