the meaning of third party b/l in a credit

Post by mmahmoodi2 » Fri Nov 02, 2001 12:00 am

it would be highly appreciated if you give me your opinino in respect of the meaning of third party b/l
when a credit prohibits the presentaion of third b/l
does such a term relate to the naming of the shipper or to the actual issuer (Third Party B/L not being accepted
meaning that it must be issued by the carrier and not the forwarder signing on behalf of a named carrier)
thank you for your kind attention

From my personal experience, third party means that the B/L of lading showing a shipper other than the beneficiary is not acceptable, if the credit stipulates so. However there might be other interpretations of this phrase as there is not authoritative interpretation of this phrase. It is better to make sure at the beginning what the instructing party really mean by this stipulation.

There is a similar stipluation "third party documments". The best advice is that do not become ASTROLOGER or a DIVINER, it would only require few minutes to prepare a swift message that can be swiftly dispatched to the issuing bank to get his clarification.

Third party documents (not) acceptable, third party b/l (not) acceptable are superflous terms which intend that any party other than the bene of the credit would be consignor/shipper or issuer of dox. Apart from inv.s any party may issue any document, and it is appropriate to say 'the bene of the credit should be also the shipper/consignor of the b/l. etc'.
