If a beneficiary presents documents in order but includes merchandise free of charge should this be raised as a discrepancy?

unless authorised in the l/c this is a discrepancy. see ICC Pub 371 pages 98-99

The beneficiary having received the intimation of docs refusal: "what an ass I made of myself."

To him I respond: “there are a number of ways people can react to what you do, your good expectations have betrayed you this time. Anyway, how people choose to react is their responsibility. I know it is a little hard to see this now if your are able to make a big hit next time or not. I bet you will.”

SHIPPING ADDITIONAL GOODS NOT CALLED FOR IN THE DC IS A VALID DISCREPANCY

Some of the goods shipped are not mentioned in the DC. This is definitely a discrepancy as it has violated the terms and conditions of the DC. Additional goods not specified in the DC may cause troubles to the applicant due to no valid import licence to import that kind of goods, difficulties in clearing the customs due to goods not that required by the DC, even if the goods are free of charge.

This decision is in fact from the father of letter of credit, the late Bernard Wheble made under ICC Decision No. 371 as pointed out by PGauntlett.
