USUALLY LOCAL LCS ISSUED ( LOCAL DELIVERY ) DOCUMENTS REQUIRED INVOICE AND DELIVERY NOT.SUCH DOCS TO BE COUNTERSIGNED BY THE APPLICANT.DOCS PRESNTED FOR NEG. AND DULY SIGNED BY APPLICANT CONFIRMING RECEIVING OF GOODS IN GOOD ORDER BUT PERIOD OF PRESENTATION EXCEEDS THAT STIPULATED IN THE L/CS. SHOUL THIS BE POINTED AS A DISCRIPANCY.?

Adel,

Need more clarification on the query. The limit given in UCP 500 article 43 is for presentation of transport documents. Since Delivery Note is not a transport document, the article will not apply provided documents are presented within the validity of the credit. The reason behind it is that buyer wants to receive the title documents within reasonable time so that they could clear the goods. In other words, they don't need to issue shipping guarantees or incur demurrage charges. In the case presented the delivery of goods have already taken place.

However, if the credit specifically indicates that documents must be presented on or before a particular period then beneficiary has to comply.

I agree with all that Abdulkader has said on this subject.

A possible explanation might be that most DCs are issued with the intention that an international transaction is involved, and standard formats for DC applications and the relevant DCs take account of this. This procedure should be altered for national transactions, but usually the same (international) form is used. This can lead to unnecessary detail being issued in the DC, such as a period for presentation of documents.
