Confirmation for despatch

Hi,

We have a credit which states
quote
one set of copy documents to be couriered,within same day of shipment and a confirmation to this effect shall accompany shipping documents.
unquote
beneficiary has presented courier receipt for the above documentary requirement. My understading is that:
1. A confirmation for couriering documents would mean that a certificate would have to be provided. If it were to be faxed as per the credit then i would have accepted a fax confirmation report as it is proof of the fact that applicant has received the fax.A courier receipt is only a proof of despatch.

Please confirm my understanding and provide your inputs.

The credit does not indicate the contents or the issuer of the confirmation of dispatch, so the courier receipt presented has to be treated as the confirmation of dispatch.

I would regard such a provision as being unclear and therefore would not like to say with any certainty what it means exactly. Whether or not a courier receipt would meet the requirement would, I imagine, depend on its actual contents, but based on the courier receipts I have seen I would regard it as being unlikely. An appropriately worded beneficiary's certificate would, I anticipate, meet this requirement.

To me, i will advise bene to present a courier receipt, which bears a shipment or despatch date and indicates the docs being sent.

I would agree with Jeremy -- I have never seen a courrier receipt that detailed the contents being sent -- at the most it says "contents : documents". So I would consider that the confirmation called for in the credit meant a written confirmation indicating the documents sent.
Once again, the problem would not have arisen had the credit been properly worded.
