Partial shipment

L/C prohibited partial shipment.

Beneficiary presented several drawings (not on the same date) i.e. seperate drafts and separate B/L but all the B/L shows same means of conveyance and for the same journey and same distination.

Can we consider this is a partial shipment as presentation of documents are not on the same day and all the B/Ls are not under one bill of exchange ?

Let me have your views.

Shahed,
Unless the credit is prohibiting partial drawings also I would treat it as complying.

L/C allowed partial drawings but my concern is Article 31 of UCP 600 where it states "A Presentation".

If beneficiary present the documents on different dates (multiple presentation) will it violate the Article 31 ?

Is "A Presentation" means one presentation ? Any ICC opinion in this regard ?

Please let us have your opinion ?

Shahed,
As long as b/ls evidence "shipment commencing on the same means of conveyance and for the same journey, provided they indicate the same destination", you're not dealing with partial shipments.
I don't know any official opinion on such a case but I don't think you need one.
It is clear as daylight: you may have how many presentations you wish.,as long as b/ls fulfill the conditions of art.31.

I wonder how a bank can determine upon receipt of the first presention if there has been a partial shipment or not and I wonder why the documents are sent in such a way.

Dear Daniel,
Reasons for doing so are many:
- the time some other documents required are obtained by the beneficiary from the issuers;
- the time some other documents required are legalized/visaed/certified
- the corrections beneficiary or other parties are making to some documents, other than b/l
etc.
Anyhow, I think presentations are made within a short period of time
e.g. two-three in a week.

Bogdan

Dear polterd,
according to the reason listed

1. I wonder why not beneficiary
present documents in one lot, once all documents are completedly prepared,
2. if documents presented on the different dates are acceptable, Is the lastest presetation date on those documents treated as presentation date?
3. How to judge if the same presentation
