name of the master on the C/P B/L

Post by ABDURRAHMANO » Mon Mar 24, 2008 12:00 am

Dear experts,
I have a question regarding to the name of the master when he signs a charter party bill of lading. It is clear that the name of the master need not be stated if the master signs a bill of lading as per ISBP 94(b). But it is not mentioned for a charter party in the par.118 of ISBP. Is that means the name of the master need to be stated if it signed by the master?

Hi,
Idon't see your problem here.

Article 22 says that a CP BL must be signed by the master, owner or charterer, or an agent for one of the above. If it's signed by the agent, the name of the owner or charterer must be indicated -- with no mention of the name of the captain. Therefore, any signature with the mention underneath "master" but without specifying his name would be acceptable.

Furthermore para 118 b. which is entitled "Signing of Charter Party Bills of Lading" is really quite specific in stating that the name of the master (capitain) need not be stated.

So maybe I'm missing something in your question?

Best regards
Judith

Dear Judith,
Thank you for your kind reply to my question. From your comment I comprehend that if a C/P B/L signed by a master or its agent on behalf of the master then in any case master name may not be stated on a C/P B/L unless credit stipulates otherwise.
