Hi all,

I kindly ask you for your assistance in the following matter:
Letter of credit required under the point B/L the following: .....notify applicant.
The applicant contains also a fax number which is only mentioned under field 'applicant'. Now the notify address of the B/L shows that fax number but missing the last digit, so paying bank states fax number within notify address incomplete. My question are:
1) Could this be taken as typing error ?
2) Could this be taken under art. 14 j of the UCP because requirement under B/L is only 'applicant' and not complete infos ?

I would be very thankful for any suggestions, just for your information, this would be the only discrepancy within the documentation.

I would say that a typing error which could have some consequences could not be considered as a typing error as per par. 25 of ISBP.

Sub-article 14 (j) comes into effect whether or not the documentary requirement in the LC calls for the full details.

It is triggered once these details are included on the transport document in the relevant fields.

The words "they must be as stated in the credit" in this sub-article would seem to mean that there is no margin for error.


Sub-article 14 (j):
..."when the address and contact details of the applicant appear as part of the consignee or notify party details on a transport document subject to articles 19, 20, 21, 22, 23, 24 or 25, they must be as stated in the credit."

I think it discrepant due to UCP Article 14j and ISBP Paragraph 25. The incomplete number would make the notification to the notify party unworkable. So, it's not a simple typo error but a discrepancy.

Given the rigorous wording used in the last sentence of 14(j) I agree with Leo that there seem to be no margin for error.
If that in fact hold true I do not know. Personally I hope not. As such this is a totally new concept – and no “international standard banking practice” has yet been established.
For that reason my suggestion would be to formulate this as query and send to the ICC Banking Commission.
