Hi every body,
I have a question need to be supported.
In F47 - additional conditions, L/C stated: 'Production date must be November 2012 and expiry date must be 18 months from the date of production. Packing list and Health cert. must confirm compliance.'
In fact, the Packing list and heath cert. that beneficiary presented evidenced Production date: November 2012 - Expiry date: April 2014.
The Issuing bank after that, sent us a MT999 stated disc. as "heath cert. and Packing list not certify the wordings as per the A/M additional condition". However, we disagree as the packing list and health cert evidenced Production date of Expiry date which stisfy that condition.
Could you give me opinion about that issue?

Is the ‘expiry date’ referred to in the condition the expiry date of the credit or some other ‘expiry date’?

L/C condition was that the Packing List and Health Certificate should confirm compliance (of the production date being Nov 2012 and expiry date of the goods 18 months thence).
Both documents show a date of production as Nov 2012 and an expiry date of April 2012, i.e.: a gap of 18 months as per L/C terms.
The L/C did not require an exact wording to appear on the documents. All that was required was the two documents to confirm compliance. The nominated and issuing banks can easily ascertain compliance of the L/C condition, given that the production and expiry dates are shown. By showing prod & expiry dates that conform to the L/C condition, the documents confirm compliance.
There is no discrepancy.

To JSMith: that's my mitake , the correct sentece is: 'the packing list and health cert evidenced Production date and Expiry date' (not of).

Pls provide us with more evidence as the issuing bank still insist on their opinion and refuse the docs

If the period from November 2012 to April 2014 is 18 months, then the discrepancy raised by the issuing bank is invalid.

Need to focus on the LC wording. If documents are to certify a "date" then its a discrepancy. Right now you have a month and year but no day.
