Description of goods in Phytosanitary Certificate

Dear DC PRO colleauges,

Appreciate your views on the following;

The LC stated description of goods as "Whole Red Lentils". All the documents presented under the LC show description as "Whole Red Lentils". However the phytosanitary certificate show description as "Lentils Red". The issuing bank is calling it a discrepancy stating that there is a conflict in the nature of goods.

LC calls for a Phytosanitary Certificate in one original.

ARTICLE 14F STATE THAT IF A CREDIT REQUIRES PRESENTATION OF A DOCUMENT OTHER THAN A TRANSPORT DOCUMENT, INSURANCE DOCUMENT OR COMMERCIAL INVOICE, WITHOUT STIPULATING BY WHOM THE DOCUMENT IS TO BE ISSUED OR ITS DATA CONTENT, BANKS WILL ACCEPT THE DOCUMENT AS PRESENTED IF ITS CONTENT APPEARS TO FULFIL THE FUNCTION OF THE REQUIRED DOCUMENT AND OTHERWISE COMPLIES WITH SUB-ARTICLE 14 (D).

Given the above, is issuing bank correct in pointing it as a discrepancy?

Refer to art. 14 which states:
e. In documents other than the commercial invoice, the description of the goods, services or performance, if stated, may be in general terms not conflicting with their description in the credit.

"Lentils red" is definitely not in conflict with "whole red lentils". It is not a discrepancy.
