ISBP K9 states "an insurance document is not to indicate an expiry date for the presentation of any claims thereunder". As part of the pre-printed wording, the ins. cert. states as instructions to the assured "If the loss or damage is not apparent at the time of taking delivery, give notice in writing to the Carrier within 3 days of delivery". It goes on to say "please note that your claim against this company may be prejudiced if you fail to preserve all rights against the parties responsible for loss or damage and/or fail to preserve and safeguard your shipment". The question is, does the mention of "within 3 days of delivery" in anyway mean an expiration date for presentation of claims? I think not. Also, I understand the meaning of "Carrier" to be the Ocean Carrier, not the Insurance carrier. Sorry for the length of the question but would appreciate any comments.
