Alleged discrepancy of short shipment by presenting bank

Our credit was issued for MYR21,400 covering 20 Metric tons of wire rods.
Partial shipment is prohibited & no additional tolerance is mentioned.

Bene's bank presented docs to us with an invoice for MYR21,070.44 covering
19.692 Metric tons. They listed it as a discrepancy underthe reason short shipment.

We are inclined to disagree as the alleged short shipment is within the tolerance of 5%.

We would appreciate if you could advise us.

Unless the L/C description specified individual units such as no. of wire rods or no. of packing cases etc, there is no discrepancy as per Article 39 b.

UCP 500 Article 39 specifies that unless the quantity of the goods is represented by packing unit, there is a 5% tolerance for goods represented by weight or volume.
