Soft / hard confirmation

Post by AbdulkaderBazara » Wed Mar 06, 2002 12:00 am

What is the meaning of "Soft Confirmation" and how does it differ from "Silent Confirmation"? Is there something called "Hard Confirmation"? Appreciate if some one quote the ICC Opinion on "Soft Confirmation" - Opinions of the Banking Commission, 1980-81, ICC Publishing, 1982, ICC Publication No.399, No.R.68, Case No.176.

It's far too long to quote. If you give me your fax no. I'll send it to you.

Soft / hard confirmation

Post by AbdulkaderBazara » Thu Mar 07, 2002 12:00 am

Jeremy,

Thanks once again. I have received the fax copy. I am clear on what "soft confirmation" is. However, it is not clear whether the issuing bank has requested for confirmation or is aware that its correspondent bank has added its confirmation. Is this a conditional silent confirmation ? Meaning unauthorized conditional confirmation? On the other hand, is there something called "Hard Confirmation"?

regards

Soft / hard confirmation

Abdulkader,

I found the whole thing most bizarre; a ‘confirmation’ apparently contingent on receiving reimbursement! I agree it is not clear whether or not the issuing bank requested confirmation; I can only assume that it did & that therefore this is not a ‘silent’ arrangement. Finally, I am not aware of anything called a ‘hard confirmation’.

Overall, given the confusion it could cause, I think it is best this ‘opinion’ is consigned to the ‘dustbin of history’.
