on deck clause in charter party bill of lading

Hello, colleagues!
The matter is the following:
The l/c initially stipulates presentation of charter party bill of lading.
presented bill of lading is OK, EXCEPT
the fact that it contains the following printed wording:
(of which ON DECK at shipper's risk, the carrier not being responsible for loss or damage howsoever arising).
Confirming does not indicate this as a discrepancy, but we are in position to do so in accordance with Article 33.
But the matter, is that in STUDY GUIDE FOR DOCUMENTARY CREDITS (you know, the guide for CDCS) there is a sample of charter party bill of lading, and it's fully identical with mine! But it's sample is given not in connection with my question (just a sample).
What do you think about that?

In the example you mention there is a space between 'of which' and 'on deck'. If part of the cargo has been carried on deck then this space will be filled in. If left blank the B/L is ok.
