Photocopy of B/L

Dear All,

L/C calls for :

'a photocopy of the original clean on board B/L consigned to the order of the buyer etc...'

without specifying that short form or blank back B/L not acceptable.

The issuing bank refused the photocopy for the following reason:
'photocopy of the reverse side of the B/L not presented'.

Knowing that nothing on the photocopy presented shows that it is issued in more than one page,
would you reject such document and on what grounds?

Dear Antoine,

This is a bit tricky; and surely one of the places where banks have not made it any easier for themselves.

Anyway – when looking at the ICC opinions on this issue, then it is clear that this is not a “transport document” (as described in UCP). This means that article 23 does not apply – and the document should be examined according to e.g. article 21!

In that perspective, it does not seem reasonable to require a copy of the reverse side of the document – especially when it is not clear from the other side (front) that such exists.

I would not reject the document on the reason mentioned here.
