i do have the folowing case:
l/c states"all the docs must be issued in english or french language".
cmr presented is preprinted in romanian and german languages but typewritten in english.
issuing bank rejected docs stating "cmr issued in romanian and german".it is or not a discrepancy ? i remind you all boxes are filled out in english.

I would suggest that you look at opinion R451 which says

A requirement for a document to be issued in a specific language does not prohibit other languages or dual languages being used, provided the information requested by the credit is clearly indicated in the requested language.

Also you could look at TA552.
HOWEVER, as an Issuing Bank, I would protest if the printed part of the document was not in a language that I had specified : documents are not for the bank's use only, but are needed by customs agents, local forwarders, and various govt authorities, which might not accept the documents they were unable to understand.

Thank you Judith. I agree with you but also I'm thinking that some documents have the same preprinted form whereever are issued: eur1,cmr,rwb.I mean,if you receive a cmr preprinted in german you already know the title/content of each box,i.e. for truck number,for consignee name and address,for goods description,etc. In principal you're checking if the cmr is filled out as per l/c. But beyond any of my try to find out a logical excuse,you are right.

Actually, with the exception of European customs documents (eur... etc.) most documents are not that standard and transport documents are far from being standardized. Bimco has offered a new BL which I would love to see be used by everyone, but that is only a dream. Also FIATA documents were fairly standardized I don't see to many of them.
As a matter of fact I always say that the high percentage of discrepancies found on transport documents is due to the fact that they are not standardized and you have to look all over the document, because some have information in one place, some in another.
I think that hope will come along these lines when electronic documents start being used. Think of how SWIFT has standardized so many banking transactions. I'm old enough to remember receiving payment instructions by telex where half the information was missing. Now at least there are mandatory fields which are always in the same place!
